Legal Notice: Artwork Purchase, Sale, and Intellectual Property Rights
By purchasing any artwork (physical or digital) from bazART, you agree to the following terms:
-
Ownership of Artwork
Upon the purchase of an artwork, you gain ownership of the physical or digital piece. However, this transfer of ownership does not include the intellectual property rights associated with the artwork. The artist retains full copyright and IP rights unless explicitly transferred in writing. -
Usage Rights
The artwork you purchase is for personal use only. You may display it in private or public spaces, but you are not permitted to reproduce, distribute, or use the artwork for commercial purposes without express permission from the artist or copyright holder. -
Resale of Artwork
You may resell the original artwork or digital file you have purchased. However, a resale royalty fee may be applicable depending on the laws governing such transactions (e.g., the Artist’s Resale Right (ARR) in some jurisdictions, Legea nr.8/1996 in Romania). It is your responsibility to ensure compliance with any relevant regulations regarding resale royalties. -
Restrictions on Reproduction
You are not authorized to make or sell copies or reproductions of the purchased artwork, whether physical or digital. This includes but is not limited to creating prints, digital duplicates, or any derivative works without the explicit permission of the artist. -
Digital Art
For digital art, you are granted a non-transferable, personal right to display the purchased file on your devices or in private digital galleries. You do not have the right to alter, distribute, or reproduce the digital artwork in any form. -
Copyright Infringement
Any unauthorized use, reproduction, or distribution of the artwork constitutes copyright infringement and may result in legal action. bazART and the respective artist reserve the right to pursue claims for any breach of intellectual property rights. -
Artist’s Moral Rights
The artist maintains moral rights over their work, including the right to attribution and protection against distortion or mutilation of the artwork that could harm their reputation. These rights remain intact even after the sale of the artwork.
